Summary

In a dispute between the Claimant and Defendant under a share purchase agreement (SPA), the Qatar Financial Centre Civil and Commercial Court dismissed the Defendant's jurisdiction challenge. The SPA mandated arbitration in Doha, Qatar, administered by the Qatar International Court and Dispute Resolution Centre (QICDRC). Despite initial proceedings in other courts, the Claimant sought the Court's appointment of a sole arbitrator per the SPA. The Defendant contested this, arguing waiver of arbitration rights and SPA invalidity due to fraud and procedural issues. The Court directed further submissions on the potential waiver of arbitration rights.
